1. Acceptance of terms
By accessing or using simetrix.com (the "Website"), you ("you" or "user") agree to be bound by these Terms of Use ("Terms") and our Privacy Policy. If you are accessing the Website on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case "you" refers to that entity.
2. Description of services
The Website provides information about Simetrix Solutions and our customer operations services. Through the Website you may:
- Learn about our services, industries, and operating model
- Request a CX Operations Review or scoping conversation
- Schedule meetings with our team
- Submit inquiries through contact forms
- Access content such as articles, case studies, and resources we publish
The Website itself is not a customer operations service. Any operational engagement requires a separate written agreement.
3. Eligibility
The Website is intended for business users aged 18 or older. By using the Website, you represent that you meet these requirements and that you are not barred from using the Website under applicable law.

This Section 5 does not apply to:

- Information shared under a separate written non-disclosure agreement
- Information shared as part of a customer engagement governed by a Master Services Agreement

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website for your own internal business evaluation purposes. This license does not include the right to:

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMETRIX SOLUTIONS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT ANY INFORMATION ON THE WEBSITE IS ACCURATE, COMPLETE, OR CURRENT.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SIMETRIX SOLUTIONS AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE WEBSITE.
OUR TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE WEBSITE SHALL NOT EXCEED ONE HUNDRED US DOLLARS (US $100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law. This Section 9 does not limit liability for matters that cannot be excluded under applicable law, such as death or personal injury caused by negligence, or fraud.

12. Governing law
These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of laws principles. Subject to Section 13, the state and federal courts located in Delaware shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms.
13. Dispute resolution

Any dispute that cannot be resolved informally shall be resolved through binding arbitration administered by a recognized arbitration body in the State of Delaware under its commercial arbitration rules, unless prohibited by applicable law. The arbitrator's decision shall be final and binding. Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.
To the maximum extent permitted by applicable law, you agree that disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action.

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date at the top of this page. If the changes are material, we will provide additional notice where appropriate. Continued use of the Website after changes constitutes acceptance of the updated Terms.
